This study investigates the role of Sheikh Hassan bin Ameir, Al-Shirazy, a prominent Muslim scholar in East Africa who taught the Fiqhi of Islam (Islamic Jurisprudence). His role is studied from his two books, Wasilatu Rajaa fii sharh safinatun najaa and Fat-hul kabiir sharhi Mukhtaswari swaghiir. These two books are famous in East Africa for the learners of Fiqh of Isam. In the two books, the Sheikh has made elaborations with clear evidence from the Quran and the Sunnah of the Prophet. This study deals with The Hanging Divorce: Legal provisions and implications in the Zanzibar Society. Part One of the study explains the meaning, ruling and the legitimacy of the hanging divorce. The second part of the study explains the conditions, kinds and effects of hanging divorce.

The third part explains the prevalence of the hanging divorce, reasons for its existence, the negative effects, its misuse and recommendations for its reduction.

Sifa bainifu ya baadhi ya kazi za fasihi ya Kiswahili za karne ya ishirini na moja ni matumizi makubwa ya mbinu za kiuandishi za kimajaribio (Mwamzandi, 2013:48). Miaka nenda rudi, fasihi ya Kiswahili imekuwa ikiing’ongona jamii kuendana na uhalisia unaolandanishwa na utanzia. Huku ikizingatiwa kuwa bado utanzia haukufanyiwa uchunguzi toshelevu kiasi ambacho husababisha kuelemewa na ugeni masikioni mwa wasomaji. Ili kuepukana na changamoto hii, makala imenuia kuichunguza mbinu hii kwa minajili ya kuleta uwelewa mpana huku ufafanuzi wake ukijikita kuweka wazi nduni zake kulingana na kalamu za waandishi wawili waliozaliwa, kulelewa na kukulia katika mazingira tofauti. Mmoja akiwa ni Adam Shafi (Haini, 2003) anayetoka kisiwa cha Unguja Zanzibar na Euphrase Kezilahabi (Rosa Mistika, 1971) mwenyeji wa kisiwani Ukerewe Tanzania Bara. Nadharia ya Upokezi imetumika katika utafiti huu ambayo iliasisiwa na Rosenblatt (1938). Ni Nadharia inayoweka mkazo nafasi ya msomaji na kutupilia mbali nafasi ya mtunzi kutoa tafsiri ya fasihi. Mbinu ya usomaji wa maktabani (nyaraka) ilitumiwa katika kukusanya data. Wakati huo huo njia ya maelezo imeuteka utafiti kwa shabaha ya kiuchambuzi. This study investigates the conflict of fiqh in North Unguja. It is associated with the differences existing in the four major schools of thought among Muslims (الاختلافات الفقهية). The study comprises the introduction which explains the importance of the topic, the reasons behind selecting it and literature review. The first part of the study discusses the meaning and features of the concept of Fiqh. This part also explains the meaning behind the existing Fiqh conflict.

Part two of the study discusses the current and old Fiqh antagonisms and their causes. The third part of the study explains the effects of Fiqh antagonism within the society.

This paper covers, “Slaughtering in Tanzania, between Sharia and Country Standards: An example of Vingunguti Slaughterhouse.” It discusses the concept of slaughter in the light of Sharia and law, with definition, impact and the wisdom of its legality. The study explains the methods and types of legal slaughter, conditions and the position of Tanzanian law on how to treat animals for slaughtering at all stages. Further, it explains some religious beliefs on the subject of slaughter. The paper gives historical overview of slaughtering in Tanzania and the tasks of the government and religious authorities in monitoring slaughterhouses. The paper sheds some light on the contemporary and traditional methods of slaughter within and outside Tanzania by indicating its benefits and challenges. Finally, the paper presents a comparison of the country’s standards and the challenges of exporting meat abroad. The result of the investigation shows the importance of Sharia with its comprehensiveness and realism on the legality of animal slaughtering

ASSESSING THE SELECTION PROCESS FOR JOINING DIPLOMA IN EDUCATION PROGRAMME

Selection of students to join any education programme is a professional decision and not simply a student right. Professional criteria should be used in making this decision instead of just academic credentials which predict performance as a student, not a teacher. This paper assesses the selection process for joining Diploma in Education Programmes in Zanzibar, Tanzania. Specifically, it explores the selection process for diploma in education programme in Zanzibar, Tanzania; and the Rationale behind the selection process for diploma in education programme in Zanzibar, Tanzania. This study was conducted in Zanzibar, Tanzania. Zanzibar Muslim College and Pemba Islamic College were involved during data collection as they are government institutions responsible for running diploma in education programme in Zanzibar. The study mainly based on qualitative research approach as the dominant methodological strategy since it required information from people’s experience, review of documents and focus group discussions. The choice of this approach based on the nature of the topic and our objectives of the study. The data of this study were obtained in June, 2021 as a part of the data collected during my master’s degree programme. The methods used were interview, classroom observation and documentary review. The data were analyzed qualitatively. The findings of this paper concluded that selection process for joining diploma in education programmes in Zanzibar, Tanzania lies under specified criteria including entry qualification based on academic background, education courses, interviews and LoI proficiency. The study recommends that the colleges should put much emphasis on applying many criteria as possible such that they can register well qualified candidates for diploma education programmes for betterment of the programme itself but also for the college rank, candidates and the country.

This paper deals with the phenomenon of frequent divorces in Zanzibar, causes and solutions: “A Study on the Court of Sharia Judiciary”. This paper comprises six sections with introduction and conclusion. It presents a historical overview of Zanzibar with its geographical, religious, social, economic and educational setup.

It presents the emergence of the Sharia court in the history of the Zanzibar judicial system, the reasons and the impact of its establishment, its judicial role in settling disputes. Prominent Zanzibar Chief Kadhis are also mentioned in the paper. It also deals with the definition of divorce in language and terminology and explains the reasons for divorce in religious, economic, social, educational and family terms.

Further, the paper deals with social, educational, family and religious challenges emanating from the phenomenon of divorce and the judicial measures that are taken to solve them. The paper concludes with results and recommendations

This paper deals with the misappropriation of public funds in Zanzibar. It covers the concept of public funds in its profound meaning and the rules pertaining to state funds. Further, the paper explains the obstacles that impede the misappropriation of public money. The paper provides solutions against the misappropriation of public funds and finally presents the conclusion.
